Stack Overflow’s Developer Experiences December 2024 Survey Giveaway (the “Giveaway”) is sponsored by Stack Exchange, Inc. (“Stack”), 14 Wall Street, 20th Floor, New York, NY 10005, and is subject to these Official Rules.

Dates of Giveaway Period

The Giveaway begins at 12:01 AM EST on November 25th, 2024 and all entries must be received by 11:59 PM PST on December 23rd (the “Giveaway Period”). Winners will be selected from entries properly submitted in accordance with these Official Rules and received during the Giveaway Period.

Eligibility Requirements

In order to participate, you must complete the Developer Experiences December 2024 Survey in its entirety by submitting answers to each survey question at the appropriate prompt (each, a “Qualified Entrant”, and, collectively, the “Qualified Entrants”). Participation in this Giveaway constitutes an entrant’s full and unconditional agreement to these Official Rules. The decisions of judges and Stack are final and binding in all respects. Stack, their respective parent companies, affiliates, and subsidiaries (the “Giveaway Entities”), their immediate families (parent, child, sibling & spouse and their respective spouses), and persons living in the same households as such individuals (whether related or not) are not eligible to participate in the Giveaway. All applicable country, state and local laws and regulations apply.

Giveaway Prize and Odds

One (1) of fifteen (15) gift cards with a value of Fifty Dollar USD ($50) each gift card. Overall odds of winning depend on the number of entries received during the Giveaway Period.

Prize Restrictions

Limit of one (1) prize per person/household. All prizes are non-transferable or assigned and no substitutions or cash redemptions; except at Stack’s sole discretion or as otherwise provided herein. Stack will not replace any lost or stolen prizes. In the case of unavailability of any prize, Stack reserves the right to substitute a prize of equal or greater value. All gift card terms and conditions apply to the use of the prizes, and are incorporated herein by reference. Each prize winner is solely responsible for all applicable federal, state and local taxes, including taxes imposed on his/her income. No more than the stated number of prizes set forth in these Official Rules will be awarded. If it is discovered during prize verification you have entered, attempted to enter, or used multiple accounts to enter more than the stated limit, you will be disqualified at the discretion of the administrator, or will be void.

Giveaway Drawing/Odds

At the end of the Giveaway Period, Stack will conduct a random drawing from all eligible entries and select fifteen (15) Qualified Entrants (each, a “Winner”, and, collectively, the “Winners”).

Each Winner, subject to verification and the potential Winner’s full compliance with these Official Rules, must follow the instructions provided by Stack in a prize notification email within ten (10) business days after issuance of the prize notification email by Stack (“Fulfillment Requirement”). Should this Fulfillment Requirement not be met, Stack reserves the right to select an alternative Winner in a subsequent random drawing from all remaining Qualified Entrants.

No compensation will be provided for any prizes that are not able to be awarded to a prize winner.

Conditions

Stack reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Giveaway, or a portion thereof.

All gift cards are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, expressed or implied. No compensation will be given for lost, stolen, or expired gift cards. Stack is not responsible for replacing lost, stolen, or expired gift cards. Fulfillment of gift cards is the sole responsibility of the merchant, not Stack, and is only redeemable as specified. The gift card must be surrendered upon redemption. All gift cards are subject to the terms and conditions regarding use, loss, theft, and redemption and all other terms and conditions established by the merchant providing that gift card. Any questions or issues regarding gift cards must be directed to the merchant customer service center and will be handled exclusively by the merchant. All transactions, disputes, questions, and all other aspects of the relationship between any prize winner and merchant are solely the responsibility of the prize winner and merchant, and Giveaway Entities shall not have responsibility for any such matters.

Giveaway Entities has not made and is not responsible in any manner for any warranties, representations or guarantees, express or implied, in fact or law, relating to the gift cards, regarding the use, value or enjoyment of the gift cards, including, without limitation, merchantability or fitness for a particular purpose.

Data Privacy

Any personal information you provide to Stack in the course of completing the Developer Experiences December 2024 Survey may be used to communicate with you in relation to this Giveaway, such as to inform Winners and/or for the other purposes specified herein. Collection and use of such personal information will be in accordance with Stack’s Privacy Policy, which can be found here: https://stackoverflow.com/legal/privacy-policy. By participating in this Giveaway, Qualified Entrants hereby agree to Stack's collection and processing of their personal information in accordance with these Official Rules and acknowledge that they have read and understand Stack’s Privacy Policy.

Any email communication from Stack will contain an appropriate link to opt-out of further research-related communications (with the exception of administration of this Giveaway).

General Release

Any attempted form of participation in this Giveaway other than as described herein is void.

By participating, entrants and prize winners agree to release, discharge, indemnify and hold harmless the Giveaway Entities, and each of their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) from and against any claims made by any entrant, prize winner, or any other third parties, related in any way to the operation of this Giveaway as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from receipt, acceptance, possession, misuse or use of a prize or participation in any promotion related activity or participation in this Giveaway.

GIVEAWAY ENTITIES WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOST DATA, LOST PROFITS, LOST REVENUE, LOST BUSINESS, ANTICIPATED PROFITS, COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, AND REGARDLESS OF WHETHER THE RELEASEES WERE OR SHOULD HAVE BEEN AWARE OF OR ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ADDITION, TO THE FULLEST EXTENT POSSIBLE BY LAW, THE GIVEAWAY ENTITIES MAXIMUM AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE GIVEAWAY, REGARDLESS OF THE NUMBER OF CLAIMS OR CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY, OR OTHERWISE), WILL NOT EXCEED $50.

ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE (INCLUDING THE SURVEY ENTRY SITE) OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND OR CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, STACK RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON(S) TO THE FULLEST EXTENT PERMITTED BY LAW.

Governing Law

The Giveaway and these Official Rules, including any disputes hereunder, will be governed, construed, and interpreted under the laws of the state of New York, without giving effect to any conflict of law provisions. Each party hereby consents to personal jurisdiction in any action brought in federal or state court in New York County, New York.
